This website, www.star-arcade.com, and Star Arcade™ mobile game service (herein jointly referred “Star Arcade™”) operated by Star Arcade Ltd. offers games, community services and other services and contents (herein referred “Services”). These Terms of use govern the Services and any use of Star Arcade™ by any user (herein referred “You”).

These Terms of use are applicable to the Star Arcade™ and only Star Arcade™ and not any other Star Arcade Ltd. websites or Services.

You may use Star Arcade™ and its Services for Your personal non-commercial purposes only and solely in compliance with these Terms of use and any applicable laws and regulations. Reproduction, distribution or storage of part or all of the contents in any form without the prior written permission of Star Arcade Ltd. is prohibited except in accordance with the following terms.

Star Arcade™ consents to You browsing Web Sites on Your computer and mobile phone or similar devices and using content as it is. Individual Services provided on Star Arcade™ may be subject to additional terms indicated in connection with the Services (such as discussion forum rules/terms of use).

By using Star Arcade™ you agree that your use of Star Arcade™ or its Services does not grant you any intellectual property rights in any content submitted by other users. You also agree that Star Arcade™ is not responsible in any way for protecting any intellectual property rights you may assert in your content.

Contents of Star Arcade™ and its Services

The Services of Star Arcade™ include games, scoreboards, community services such as discussion forum and messaging systems with users unique and customizable profiles with possibility of uploading profile pictures etc. Star Arcade™ may include some other Services too. Star Arcade™ may also include third party content such as advertisements and other information. Star Arcade is not responsible of those third party contents and information. When you visit these sites, we suggest that you read their Terms of use and privacy policies. Star Arcade™ is not responsible for the Terms of use or privacy policies of such sites.

The use of some Star Arcade™ Services may be subject to charges and fees and/or registration. Registration and use of Star Arcade™ website is free of charge. During registration process you are requested to submit personally identifiable information. Star Arcade™ is committed to protecting your privacy and therefore we process and save your personal information safely. You can read more about our Privacy Policy here. By accepting these Terms of use, You also accept our Privacy Policy.

Playing games with your browser, mobile device or any else device on Star Arcade™ may be subject to monthly/yearly fee (“Subscription”). With Subscription and registration you get full functionality to all Services with multiplayer possibilities, scoreboards, buddy lists, discussion forums etc. To be able to play Premium Games You may be charged a fee for each Premium Game download. Playing of these games as a single player mode does not require subscription. Playing of Premium Games as a multiplayer mode is subject to Subscription.

Terms of payment and amounts of charges and fees are presented in connection with the use of Services.

Star Arcade™ may without prior notice change or remove parts of the Services and control what parts of the Service are usable to all or registered users only.

Star Arcade™ will send periodical newsletters to registered users. You may unsubscribe from receiving newsletters on your user details web page.

Location-Based Services

By accepting these Terms of use you also accept that Star Arcade collects location information about you at the time you are using Star Arcade. Please see information on how the location information is collected, used and stored from our Privacy Policy.

Submissions by You

In several places such as Your profile or discussion forum in Star Arcade™ You can submit material such as photos, data and other information for other users to see. You can also send private messages to another users in Star Arcade™. By submitting such material to Star Arcade™ or sending a message to another user, You expressly agree that:

the material or message will not contain any item that is unlawful or otherwise inappropriate due to its libelous, slanderous, defamatory nature or any other manner
you own that material or have unlimited right to submit it to Star Arcade™ and Star Arcade™ may publish that material free of charge in our products without liability
you will not take action against us in relation to material that you submit and you agree to indemnify us if any third party takes action against us in relation to the material you submit
you license Star Arcade™ and its affiliates and sub- licensees a non-exclusive, royalty-free and free of charge, perpetual, worldwide, irrevocable, and fully sub-licensable right to use, reproduce, modify, adapt, communicate to the public, make available, publish, translate, copy, create derivative works of, distribute, and display submissions throughout the world in any media, without compensation, restrictions on use, acknowledgement of source, accountability or liability, and with waiver of all moral rights including performer's rights and rights of attribution, integrity and identity

Star Arcade™ does not and cannot review the content submitted by You on Star Arcade™ and is not liable in any way for such content. Star Arcade™ may at any time without notification remove any content submitted by You or other users. Star Arcade™ asks You to inform us any inappropriate behavior or content seen on Star Arcade™.

The following are examples of violations that may result in suspension from Star Arcade™:

submit or send any material that is unlawful, fraudulent, libelous, slanderous, defamatory or invasive of another person’s rights
submit or send something to Star Arcade™ or to other user that contain vulgar, abusive or otherwise inappropriate language
submit or send any material that Star Arcade™ may deem harmful, derogatory, obscene, harassing, pornographic, hateful, threatening, objectionable with respect to race, religion, creed, national origin or gender, or otherwise unfit for publication
submit or send any material that violate or infringe any patent, copyright, trademark, trade secret or any other proprietary intellectual property rights of others
submit or send or somehow publish any information that contains a virus, Trojan horse, “sniffer” routines, backdoors, worms, time bombs, bots, robots, spiders or any other harmful code, file, program or other contaminating or destructive routines or features
submit or send any material or information that suggests or encourages any illegal activities
submit or send any unauthorized or unsolicited bulk e-mail solicitations, chain letters, advertisements, marketing or promotional materials, "junk mail", "spam", pyramid schemes or any other solicitations or communications
register with or otherwise submit or use a false name, identity, e-mail address or impersonate any person or entity
using Star Arcade™ to “stalk” or harass another person or collect personal information from minors or any other users

Age restrictions

You must be at least 13 years old to register to and use Star Arcade™. If You are at least 13 years old but deemed as a minor under your country laws, You may register and use Star Arcade™ under your parents or legal guardians control and prior approval after reading these Terms of use and other possible Service specific terms together with them.

To the greatest extent permitted by the applicable law, any parents or legal guardians consenting to their minors to use Star Arcade™ shall be liable for the use of Star Arcade™ by their minors.

Data transfer methods and fees

To use Star Arcade™ and its Services with Your mobile or other device You need a suitable device and appropriate data connection. It may be possible to play some games without a data connection. Supported devices are listed in FAQ section. Your service provider must support data traffic delivery modes such as GPRS, 3G, 4G, WLAN in order to use Star Arcade™ Services like multiplayer games and you must be subscribed to those services. You are responsible for your ability to use Star Arcade™ with your connection. For any information or help regarding your data connection please consult with your service provider.

You may be charged additional fees from your operator or service provider for using mobile data services. Star Arcade™ assumes no responsibility for the payment of such fees. Your operator or service provider is in every respect responsible for the services it provides to you.

Security

Your registration to Star Arcade™ is personal and cannot be transferred. Only one registration is allowed per person. You are responsible for your contact information being up to date, in order to enable proper service. You are personally responsible for all usage of Star Arcade™, accessed with your identification and password. You may not use anyone else’s account at any time or allow anyone else to use your account.

If your accounts identification and/or password is compromised or you are aware of someone else’s accounts identification and/or password is compromised, you are responsible for notifying Star Arcade™ immediately. See the end of this document for contact information. You can also change your password in your Star Arcade™ user details web page.

Star Arcade™ has taken measures to protect against the loss, misuse and/or alteration of the information under Star Arcade™’s control, including Your personal information. These measures include, among other, a firewall to prevent unauthorized access to Star Arcade™’s system and information stored. Although Star Arcade™ exercises reasonable care in providing secure transmission of information between Your computer and Star Arcade™’s servers, Star Arcade™ does not warrant the security of any information transmitted to Star Arcade™ over the internet or by other electronic means whether by wire or over the air and Star Arcade™ disclaims, to the greatest extent permitted by law, liability for any involuntary disclosure. In connection with any chargeable Services, Star Arcade™ and/or its third party service providers will attempt to protect the transmission of credit card information through industry standard, SSL (secure socket layer) encryption. However, please notice, that some aspects of the Star Arcade™ are not secure such as the discussion forum or other message or communication facilities and Star Arcade™ recommends that You do not disclose personal information or sensitive information in these non-secure areas, as Star Arcade™ cannot control third party access to or use of such information in such areas.

Gaming Tournaments (Play for Prizes)

In order to register for Tournaments You must:

be a natural person with full legal capacity (not minor) to participate in Tournaments
be a citizen or resident of a country where skilled gaming is legal
not be employee or employee family member of Star Arcade or its co operation Partners
comply with these Terms of Use at all times
comply with Your local tax regulations in order to report any income from Tournaments taxable in Your own jurisdiction

The rules, results and winners of each Tournament will be determined by Star Arcade, and such determinations are final. By registering and/or participating in any tournament, you agree to be bound by these determinations.

Star Arcade reserves the right to terminate your account, limit or prohibit your participation in any game or tournament.

By registering for an account and/or participating in any tournament or game offered on the Site, you consent to allow Star Arcade to access your account information to investigate complaints or other allegations of abuse.

Any person whose access has been suspended or terminated may not re-register for, or re-access, the Site without Star Arcade’s prior written consent. You are responsible for everything that is done on or through your account while you are a member of the Site.

Governing Law

By using these Services and Site you and Star Arcade agree that all matters relating to your access to, or use of, this Site shall be governed by and construed in accordance with the laws of Finland, without giving effect to any principles of conflicts of law.

Breach of the Terms of use

In the event Star Arcade™ deems that you are in whatsoever manner in breach of the Terms of use, Star Arcade™ shall take any appropriate action to address your breach, including without limitation, content deletion, termination of Subscription, prevention of access to Star Arcade™ and any necessary legal action. Star Arcade™ is not responsible of returning any fees or charges paid in case of breach of the terms of use.

Star Arcade™ asks You to inform us if You are aware of anyone who breaches these Terms of use on Star Arcade™.

Limitation of Liability and Limited Warranty

STAR ARCADE LTD. DOES NOT WARRANT THAT STAR ARCADE™ AND/OR ITS SERVICES WILL BE ERROR-FREE OR WORK OR BE AVAILABLE WITHOUT INTERRUPTIONS. USE OF THE STAR ARCADE™ AND/OR ITS SERVICES, INCLUDING BUT NOT LIMITED TO DOWNLOADING AND/OR OBTAINING ANY INFORMATION, CONTENT OR OTHER MATERIAL FROM STAR ARCADE™ AND/OR ITS SERVICES IS AT YOUR SOLE RISK. STAR ARCADE LTD. IS NOT LIABLE FOR THE NON-AVAILABILITY OF THE STAR ARCADE™ OR ITS SERVICES HOWEVER CAUSED. YOU SHALL BE SOLELY LIABLE FOR ANY DELAY, DATA LOSS OR DAMAGE TO COMPUTER OR MOBILE DEVICE FROM STAR ARCADE™ OR ITS SERVICES. STAR ARCADE™ AND ITS SERVICES ARE PROVIDED SOLELY ON “AS IS” AND “AS AVAILABLE” BASIS.

STAR ARCADE LTD. DISCLAIMS ANY AND ALL WARRANTIES REGARDING STAR ARCADE™ AND ITS SERVICES, EXPRESS OR IMPLIED, STATUTORY OR OTHERWISE, INCLUDING BUT NOT LIMITED TO THE WARRANTIES OF MERCHANTABILITY, TITLE, NON-INFRINGEMENT AND SUITABILITY OF STAR ARCADE™ AND ITS SERVICES FOR A PARTICULAR PURPOSE. STAR ARCADE LTD. RESERVES THE RIGHT TO REVISE, AMEND AND WITHDRAW ACCESS TO STAR ARCADE™ AND ITS SERVICES AT ANY TIME, INCLUDING CLOSING STAR ARCADE™ OR ITS SERVICES FOR ANY PERIOD OF TIME, ALL WITHOUT ANY LIABILITY TO YOU. FURTHERMORE STAR ARCADE LTD. DOES NOT WARRANT THAT STAR ARCADE™ OR ITS SERVICES OR ANY INFORMATION SHOWN OR MADE AVAILABLE ON STAR ARCADE™ IS ACCURATE, CORRECT OR OTHERWISE RELIABLE.

TO THE GREATEST EXTENT PERMITTED BY THE APPLICABLE LAW, STAR ARCADE LTD. SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTIAL, CONSEQUENTIAL, SPECIAL OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO ANY LOSS OR CORRUPTION OF DATA, LOSS OF PROFITS OR REVENUE OR BUSINESS INTERRUPTION ARISING OUT OF THE USE OF OR ANY INABILITY TO USE STAR ARCADE™ AND/OR ITS SERVICES, EVEN IF THE POSSIBILITY OF SUCH DAMAGES HAS BEEN ADVISED. AS SOME JURISDICTIONS MAY NOT ALLOW EXCLUSION OF CERTAIN WARRANTIES OR LIMITATION OF LIABILITY, THE ABOVE LIMITATIONS AND EXCLUSIONS MAY NOT APPLY TO YOU. IN THIS CASE STAR ARCADE LTD.’S TOTAL AGGREGATE LIABILITY FOR ANY DAMAGES AND EXPENCES ARISING OUT OR RELATING TO THESE TERMS OF USE, STAR ARCADE™ AND ITS SERVICES IS LIMITED TO THE GREATEST EXTENT PERMITTED BY LAW, OR TO TEN U.S. DOLLARS (USD 10.00), WHICHEVER IS LESS.
